The rules, in the order they come up
Written to be read once, not to be survived. Where a clause has a working equivalent elsewhere on this site — the rate lock, the returns window, the warranty — it links to it rather than restating it, because two wordings of one rule always end up disagreeing.

These terms govern every sale made through CryptoHardware by Kernhardt Systems GmbH, Röntgenstraße 14, 22335 Hamburg. They apply as they stand on the day you order.
1Who these apply to
We sell to consumers and to businesses, in the 56 countries listed on the shipping page. Where a clause below gives a consumer more than the law requires, it applies to businesses too unless it says otherwise.
Your own purchasing terms do not apply, even if you send them to us, unless we agree to them in writing.
2When a contract exists
Everything on the shelf is an invitation to order, not an offer. Your order is the offer. We accept it by producing a payment address for you — which is what the payment screen is — and the contract is formed at that moment.
We may decline an order without giving a reason: most often because stock ran out between the shelf and the till, or because a carrier stopped serving a destination. Nothing is charged when we decline, because nothing is charged before you send coins at all.
3Prices, and how a crypto amount is fixed
All prices are in US dollars and include no VAT at the point of display; German VAT is added where it is due, and is shown before you pay. Prices in other currencies on this site are a display conversion — the contract is in dollars.
The dollar total is converted to your chosen coin at the market mid-price when the payment screen opens, with no spread and no surcharge, and is then held for 30 minutes. The mechanics, including what happens when that window expires, are set out on the rate lock page and form part of these terms.
Network fees are yours and are paid to the chain, never to us. Payments that arrive short, over or late are handled as described under underpaid or late payments.
4Delivery, risk and title
We ship from Germany, to your door only, by the carrier you chose at checkout. Delivery windows are working-day estimates that start when your payment confirms on-chain — they are not guaranteed dates, and a carrier delay is not a breach of these terms.
Risk passes to you on delivery if you are a consumer, and on handover to the carrier if you are a business. Title stays with us until the order is paid in full — which, given payment precedes dispatch, is a formality in almost every case.
Import duties and taxes outside the EU customs union are yours, collected by the carrier before delivery. We declare contents and value accurately and will not do otherwise; see discreet packaging.
5Cancellation and returns
Consumers in the EU have a statutory right of withdrawal of 14 days from delivery, without giving a reason. We extend this to 30 days as a contractual right. The conditions, the exclusions and the procedure are on the returns page and form part of these terms.
Refunds are paid in the coin used for the order, to an address you provide, at the rate on the day the refund is sent — see refunds. By ordering you accept that a crypto refund may differ in coin quantity from the amount you sent.
6Warranty
The statutory guarantee of conformity applies: 24 months from delivery for consumers. We handle it ourselves rather than referring you to a manufacturer. What is covered, what voids it, and how an RMA runs are on the warranty page.
Goods are new and sealed, sourced as described under where the stock comes from. We do not sell used, refurbished or grey-import stock.
7Liability
We are liable without limit for injury to life, body or health, for intent and gross negligence, and where liability is mandatory under the German Product Liability Act.
For ordinary negligence we are liable only where we breach an obligation essential to the contract — delivering the right goods, in working order, on time — and then only for the loss typically foreseeable in a sale of this kind. All other liability is excluded.

8Risks specific to paying in crypto
By choosing to pay on-chain you accept two things no shop can undo for you.
- A transfer on the wrong network cannot be recovered by us, by you or by anyone. The payment screen states the network in words for this reason — see coins and networks.
- Coin prices move. The lock protects you for 30 minutes; outside that window, value is what the market says it is.
We accept no card payment, operate no credit, and hold no customer balance. There is nothing to charge back, and equally nothing of yours sitting on our books.
9Circumstances beyond control
Where war, sanctions, carrier suspensions, chain outages, customs action or similar events beyond our control prevent performance, our obligations are suspended for the duration. If they persist beyond 30 days either party may cancel, and anything paid comes back in full.
10Law, venue and severability
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of the mandatory protections of your own country of residence.
For merchants, the place of jurisdiction is Hamburg. If any clause here is or becomes invalid, the rest stands.
